Terms of Service

Our terms and conditions

Effective Date: 11 March 2026

Welcome to SpeakNow. These Terms of Service ("Terms") govern your access to and use of the SpeakNow platform, available at speakn0w.com ("Platform"), operated by Zed Haque Pty Ltd (ABN 47 647 964 887) ("we", "us", or "our").

Our registered address is 9 Maple Tree Road, Westmead, New South Wales 2145, Australia.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Platform.

1. Eligibility

You must be at least 18 years of age or the age of majority in your jurisdiction (whichever is greater) to use the Platform. By using the Platform, you represent and warrant that you meet these eligibility requirements.

2. Account Registration

To access certain features of the Platform, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security and confidentiality of your login credentials.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately at help@speakn0w.com if you suspect any unauthorised use of your account.

3. Use of the Platform

We grant you a limited, non-exclusive, non-transferable, and revocable licence to access and use the Platform for its intended purpose, subject to these Terms.

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable law, including Australian Commonwealth and State laws.
  • Interfere with, disrupt, or compromise the security or integrity of the Platform or its infrastructure.
  • Attempt to gain unauthorised access to any part of the Platform, other user accounts, or related systems.
  • Use automated tools, bots, scrapers, or similar technologies to access or collect data from the Platform without our prior written consent.
  • Upload, transmit, or distribute any content that is harmful, offensive, defamatory, obscene, or otherwise objectionable.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

4. Intellectual Property

All content, features, and functionality on the Platform — including but not limited to text, graphics, logos, trademarks, software, and design — are the exclusive property of Zed Haque Pty Ltd or its licensors and are protected by Australian and international intellectual property laws, including the Copyright Act 1968 (Cth) and the Trade Marks Act 1995 (Cth).

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any Platform content without our prior written permission.

5. User Content

You retain ownership of any content you submit, post, or upload to the Platform ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to use, reproduce, modify, adapt, publish, and display such content in connection with operating and improving the Platform.

You represent and warrant that you own or have the necessary rights to submit your User Content and that it does not infringe the intellectual property rights or other rights of any third party.

6. Third-Party Services

The Platform may integrate with or contain links to third-party services. We are not responsible for the content, privacy practices, or availability of any third-party service. Your use of such services is at your own risk and subject to their respective terms and policies.

7. Payment and Subscriptions

Certain features of the Platform may require a paid subscription. By subscribing, you agree to pay all applicable fees as described on the Platform at the time of purchase. Unless otherwise stated:

  • Subscription fees are billed in advance on a recurring basis (monthly or annually, as selected).
  • All fees are quoted in Australian Dollars (AUD) and are inclusive of GST where applicable.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing cycle.
  • We reserve the right to change pricing with reasonable notice. Continued use of the Platform after a price change constitutes acceptance of the new pricing.

Refunds are handled in accordance with the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

8. Disclaimer of Warranties

To the maximum extent permitted by law, the Platform is provided on an "as is" and "as available" basis. We make no warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.

9. Limitation of Liability

To the maximum extent permitted by Australian law, Zed Haque Pty Ltd, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Platform.

Where our liability cannot be excluded under the Australian Consumer Law, our total liability to you for all claims is limited to the amount you have paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Zed Haque Pty Ltd, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms or your use of the Platform.

11. Suspension and Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, indemnification, and limitation of liability) shall continue in full force and effect.

12. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and disclose your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by posting the revised Terms on the Platform and updating the "Effective Date" above. Your continued use of the Platform after the changes take effect constitutes your acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia, and any courts of appeal from them, for resolving any disputes arising out of or in connection with these Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Zed Haque Pty Ltd regarding your use of the Platform and supersede all prior agreements and understandings.
